On January 22, 2026, South Korea's Act on the Development of Artificial Intelligence and Establishment of Trust (the "AI Basic Act") took effect. It is the world's second comprehensive AI regulatory framework after the EU AI Act — but effectively the first to apply in full from day one. If your business operates Voice AI in call centers or customer-facing channels, now is the time to assess what this law demands of your systems.
What Is High-Impact AI?
Rather than the EU's "high-risk" label, Korea's law uses "high-impact" — a deliberately value-neutral term that allows flexible interpretation. It covers AI in 10 critical domains: energy, healthcare, nuclear power, criminal investigation, recruitment, credit assessment, transportation, public services, education, and water supply. The system must also pose a material risk to human life, safety, or fundamental rights.
The key principle is a dual test: domain relevance plus impact severity. Simply operating in one of the 10 domains does not automatically trigger high-impact classification — the system must demonstrably affect individuals' rights or safety.
Does Voice AI Qualify as High-Impact?
It depends on the use case. A simple FAQ bot likely does not qualify. But Voice AI that pre-screens loan applicants, processes insurance claims with approval or denial recommendations, or performs medical symptom triage could well fall under the high-impact designation.
Article 27 of the AI Basic Act: Operators of high-impact AI must establish risk management plans, implement explainability protocols, create user protection plans, maintain human oversight mechanisms, and retain compliance documentation for five years.
When classification is unclear, operators can request a formal determination from the Ministry of Science and ICT (MSIT). Best practice is to conduct a self-assessment first, then seek official confirmation for borderline cases.
Generative AI Transparency — Applies to All Voice AI
Regardless of high-impact status, all operators using generative AI must comply with transparency obligations. AI-generated text, speech, and media must be labeled so users can recognize it. For Voice AI, this typically means announcing "This is an AI agent" at the start of every call.

Korea's maximum fine stands at KRW 30 million (~USD 21,000), modest compared to the EU's revenue-proportional penalties (up to EUR 35 million or 7% of global turnover). However, enforcement may tighten after the grace period through enforcement decree amendments.
